 There is no implied DISTINCT. The reason why query 1 has spool error and not query 2 is - The 2 queries are different, and can give you different results, if the derived table query has complete row dups. I bet 
     select col3, col4 from table2
gives you many, many complete row dups. And if you did increase spool and let query 1 run, you will get large output that you did not intend to get. Looks like you already found that query 2 is what you really want. Kumaran Anantaraman
